1. Who We Are
Eternly ("we," "us," or "our") operates a software-as-a-service platform that helps venues manage weddings, connecting venues, vendors, couples, and guests in one place.
This Privacy Policy explains how we collect, use, disclose, and protect your Personal Information when you access or use the Eternly platform and any associated websites or services (collectively, the "Service").
We are bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth). Our primary place of business is in Queensland, Australia.

2. Who This Policy Applies To
This policy applies to all users of the Service, including:
- Venues — organisations or individuals who create and manage Wedding Files
- Vendors — service providers invited to participate in a Wedding File
- Couples — individuals whose wedding is being managed on the platform
- Guests — individuals invited to a wedding event through the platform
If you are a Couple or Guest whose information has been added to the platform by a Venue, please note that the Venue acts as the primary data controller for your information in that context. We encourage you to contact the relevant Venue if you have questions about how they have shared your information with us.
3. What Personal Information We Collect
We only collect Personal Information that is reasonably necessary to provide the Service. The following is not an exhaustive list of information that is collected and serves as a reference only.
3.1 Information You Provide Directly
- Account information: Name, email address, and password when you register for an account.
- Profile information: Any additional information you choose to add to your profile, such as a business name, phone number, or profile photo.
- Payment information: When a Venue creates a Wedding File, we collect billing details including name, billing address, and payment card information. Payment card data is processed by our payment provider and is not stored directly by us.
- Wedding File content: Any data, documents, notes, messages, guest lists, vendor details, timelines, or other content you upload or create within the Service.
- Communications: If you contact us for support or with a question, we retain a record of that communication.
3.2 Information Collected Automatically
- Log data: When you access the Service, our servers automatically record information such as your IP address, browser type, operating system, referring URL, pages visited, and date and time of access.
- Usage data: We collect information about how you interact with the Service, such as features used, actions taken, and time spent.
- Device information: We may collect information about the device you use to access the Service, including device type and unique device identifiers.
- Cookies and similar technologies: We use cookies and similar tracking technologies to maintain your session, remember your preferences, and understand how the Service is used. See Section 9 for more detail.
3.3 Information About Third Parties (Couples and Guests)
Venues and Vendors may upload Personal Information relating to Couples, Guests, and other third parties as part of managing a Wedding File. This may include names, contact details, dietary requirements, accommodation preferences, and other event-related information.
If you are a Venue or Vendor uploading third-party Personal Information, you warrant that you have obtained all necessary consents and have a lawful basis for sharing that information with the Service, and that you have informed those individuals that their data may be processed in accordance with this policy.
4. How We Use Your Personal Information
We use Personal Information for the following purposes:
- To provide and operate the Service — including creating and managing accounts, processing Wedding File creation and associated payments, and enabling collaboration between Venues, Vendors, Couples, and Guests.
- To process payments — including verifying payment details and maintaining transaction records.
- To communicate with you — including sending account-related notifications, responding to support requests, and sending service updates.
- To improve the Service — including analysing usage patterns, diagnosing technical issues, and developing new features.
- To protect the security and integrity of the Service — including detecting and preventing fraud, abuse, and unauthorised access.
- To comply with legal obligations — including responding to lawful requests from government or regulatory bodies and meeting our obligations under applicable law.
- To send marketing communications — where you have consented, or where we have a legitimate interest in doing so. You may opt out at any time (see Section 7).
We will not use your Personal Information for any purpose that is incompatible with the purpose for which it was collected without your consent or as otherwise required by law.
5. Legal Bases for Processing
Where applicable data protection law requires us to identify a legal basis for processing your Personal Information, we rely on the following:
- Contractual necessity — processing necessary to perform our agreement with you, such as providing the Service and processing payments.
- Legitimate interests — processing necessary for our legitimate interests (or those of a third party), where those interests are not overridden by your rights, such as improving the Service, preventing fraud, and communicating with users.
- Legal obligation — processing necessary to comply with a legal obligation.
- Consent — where you have given us clear consent to process your Personal Information for a specific purpose, such as marketing communications or the use of non-essential cookies.
6. How We Share Your Personal Information
We do not sell your Personal Information. We share it only in the following limited circumstances:
6.1 Within the Platform
Personal Information associated with a Wedding File is accessible to users who have been granted access to that Wedding File by the Venue. For example, a Venue may grant access to Vendors, Couples, and Guests at varying levels of visibility.
6.2 Service Providers
We engage trusted third-party service providers who assist us in operating the Service. These may include:
- Payment processors
- Cloud hosting and infrastructure providers
- Email delivery services
- Analytics providers
- Customer support tools
6.3 Legal Requirements
We may disclose Personal Information if we believe in good faith that disclosure is required by law, a court order, or a regulatory authority, or is necessary to protect our rights, the safety of users, or the public.
6.4 Business Transfers
In the event of a merger, acquisition, or sale of all or part of our business, Personal Information may be transferred to the acquiring entity as part of that transaction. We will notify you of any such change and the updated policy that applies.
6.5 With Your Consent
We may share your information with third parties where you have given us explicit consent to do so.
7. Marketing Communications
We may send you promotional emails or other marketing communications where you have opted in, or where we have a legitimate interest in contacting you about related services.
You can opt out of marketing communications at any time by:
- Clicking the "unsubscribe" link in any marketing email; or
- Contacting us at hello@eternly.io.
Opting out of marketing communications will not affect transactional or account-related messages, which we may still send as necessary.
8. How Long We Keep Your Information
We retain Personal Information for as long as necessary to fulfil the purposes for which it was collected, including to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements.
Specific retention periods:
- Account data: Retained for the duration of your account, and for a number of days as defined in our Terms of Service days following account closure, after which it will be deleted or anonymised.
- Payment records: Retained for 7 years in accordance with Australian taxation and financial record-keeping obligations.
- Log and usage data: Generally retained for up to 90 days.
You may request deletion of your data at any time (see Section 10). Some information may be retained beyond these periods where required by law.
9. Cookies and Tracking Technologies
We use cookies and similar technologies (such as local storage and session tokens) to:
- Keep you signed in to your account
- Remember your preferences
- Understand how the Service is used
- Improve performance and security
Essential cookies are required for the Service to function and cannot be disabled.
Analytics cookies help us understand usage patterns. You may opt out of these through your account settings or browser settings.
We do not use cookies for advertising or to track you across third-party websites.
10. Your Rights
10.1 Australian Privacy Rights
Under the Privacy Act 1988 (Cth) and the Australian Privacy Principles, you have the right to:
- Access the Personal Information we hold about you
- Correct Personal Information that is inaccurate, out of date, incomplete, irrelevant, or misleading
- Complain about a breach of the APPs to us, or to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au
- Opt out of direct marketing communications
To make a request, please contact our Privacy Officer at hello@eternly.io. We will respond within 30 days. In some circumstances we may be unable to provide access (for example, where doing so would unreasonably impact another person's privacy), and we will explain why in writing if that is the case.
11. Data Security
We implement appropriate technical and organisational measures to protect your Personal Information from unauthorised access, disclosure, alteration, or destruction. These measures include:
- Encryption of data in transit (TLS) and at rest
- Access controls limiting who can view Personal Information
- Regular security reviews and monitoring
No method of transmission or storage is completely secure. While we work hard to protect your information, we cannot guarantee absolute security. In the event of a data breach that is likely to result in serious harm, we will notify affected users and the OAIC as required by the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).
12. Overseas Disclosure
We may disclose Personal Information to service providers located outside Australia. Where we do so, we take reasonable steps to ensure that the overseas recipient handles your Personal Information in a manner consistent with the Australian Privacy Principles. Our primary infrastructure and service providers operate in Australia and the United States.
13. Children's Privacy
The Service is not directed at individuals under the age of 18. We do not knowingly collect Personal Information from children. If you believe a child has provided us with Personal Information without appropriate consent, please contact us at hello@eternly.io and we will take steps to delete that information.
14. Links to Third-Party Services
The Service may contain links to or integrations with third-party websites or services. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you use in connection with Eternly.
15. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or by posting a prominent notice in the Service before the change takes effect. The "Last Updated" date at the top of this policy reflects the most recent revision.
Your continued use of the Service after any changes constitutes your acceptance of the updated policy.
